Terms and Conditions

Effective date: 10 September 2026

These Terms and Conditions ("Terms") govern use of Epicrange websites, Client Area and services. By ordering, activating, renewing or using a service, the customer agrees to these Terms together with the applicable order, quotation, product description, acceptable-use rules and any service-specific terms presented before purchase.

Orders and Electronic Transactions

Product descriptions, prices, billing periods, setup fees, minimum terms and material limitations applicable to an order will be displayed or communicated before checkout or acceptance. Customers must review the order and correct errors before final submission. An order is subject to acceptance, payment, availability, verification and any technical feasibility checks applicable to the service.

Where consumer legislation applies, nothing in these Terms is intended to exclude or restrict a right that cannot lawfully be excluded or restricted.

Prices, VAT and Payment

Prices are stated in South African rand unless otherwise indicated. The checkout, quotation or invoice should clearly state whether VAT is included and identify applicable setup, installation, domain, hardware, delivery or other charges. Recurring services are billed according to the selected billing cycle.

Customers are responsible for paying invoices by their due dates. Epicrange may send reminders and, subject to applicable law and the relevant service terms, may suspend or restrict overdue services after appropriate notice. Reconnection or restoration may be subject to applicable charges disclosed to the customer.

Hosting Services

Hosting resources are subject to the limits of the purchased package, including disk space, CPU, memory, I/O, inode, bandwidth, database, email or other technical limits. References to unlimited features, where used, do not permit abusive, excessive or unlawful use and remain subject to fair and technically reasonable use.

Customers are responsible for website content, application updates, passwords and any software they install unless a managed service expressly states otherwise. Epicrange may take reasonable action to protect its systems and other customers from compromised websites, malware, spam or abusive resource consumption.

Free Basic / AI Website Builder

Where a hosting package includes a Free Basic Website or access to the Epicrange AI Website Builder, the feature is provided subject to the capabilities and limits of the applicable package and third-party platform. AI-generated content may contain inaccuracies. The customer must review and approve all text, images, pricing, claims, legal notices and other generated content before publication.

A free website-builder benefit does not necessarily include custom development, copywriting, e-commerce setup, SEO services, ongoing content changes or bespoke design unless expressly stated in the order.

Domains

Domain registration and transfer are subject to availability, registry policies, registrar rules and applicable fees. Epicrange cannot guarantee that a requested domain will remain available until registration is successfully completed. Customers must provide accurate registrant information and are responsible for renewals unless an automatic-renewal arrangement applies.

Domain registration, renewal and transfer fees may be non-refundable once submitted to or processed by the relevant registry or registrar, to the extent permitted by law.

Email

Customers must not use Epicrange email services for spam, phishing, malware distribution, unlawful bulk messaging or conduct that harms the reputation or operation of Epicrange systems or third-party networks. Mailbox and sending limits may apply according to the hosting/service package and reasonable anti-abuse controls.

Epic Voice, SIP, PBX and Call-Centre Services

Epic Voice is a SIP account/service and should not be represented as a PBX extension unless the customer has a separate PBX service. Voice quality and availability can depend on internet connectivity, local networks, devices, power and upstream telecommunications providers.

Telephone numbers, geographic numbers, porting and related services may be subject to verification, network availability, regulatory requirements and third-party operator processes. Customers are responsible for lawful use of calling, recording and communications features.

Emergency-calling capabilities, number presentation and location-related features may differ from traditional fixed telephone services. Any service-specific limitations must be clearly disclosed to the customer before activation.

Connectivity

Fibre, LTE and other connectivity services are subject to coverage, feasibility, installation, network availability and upstream-provider terms. Quoted speeds may be affected by Wi-Fi conditions, customer equipment, network congestion, destination networks and other factors outside Epicrange's reasonable control.

Installation lead times are estimates unless expressly guaranteed in writing.

Acceptable Use

Customers may not use Epicrange services to engage in unlawful activity or to host, transmit, facilitate or distribute content or traffic that infringes rights, compromises systems or materially harms networks or other users. Prohibited conduct includes unauthorised system access, malware, phishing, spam, denial-of-service activity, fraudulent use and deliberate attempts to circumvent security or resource controls.

Epicrange may investigate suspected abuse and take proportionate protective action, including restricting or suspending affected services where reasonably necessary, subject to applicable law and contractual obligations.

Backups and Customer Data

Where backups are included, they are a disaster-recovery or convenience feature and do not remove the customer's responsibility to maintain independent copies of important data unless Epicrange has expressly contracted to provide a managed backup service with defined retention and recovery commitments.

Restoration is subject to backup availability, retention periods and technical feasibility. Customers should not rely on a single backup copy for business-critical information.

Service Availability, Maintenance and Third Parties

Epicrange aims to provide reliable services but does not promise uninterrupted availability unless a specific service-level agreement states otherwise. Planned maintenance, emergency maintenance, upstream failures, power/network incidents, cyberattacks and events outside reasonable control may affect service.

Some services rely on third-party suppliers. Where lawful, Epicrange may change an upstream supplier or technical platform provided that the core contracted service is not materially reduced without appropriate notice or remedy.

Cancellations, Fixed Terms and Renewals

Cancellation rights and notice periods depend on the specific service, whether the customer is a consumer for purposes of applicable legislation, the selected billing term, third-party commitments and any fixed-term agreement. The order or service-specific terms must state any minimum duration and cancellation requirements.

Epicrange will apply statutory cancellation and cooling-off rights where they apply. Customers should submit cancellation requests through the Client Area or another designated written channel so that the request can be recorded and verified.

Refunds

Refund eligibility depends on the service, the reason for cancellation, work already performed, third-party charges already incurred and applicable consumer law. Fees that Epicrange has irrevocably paid to a registry, carrier, installer or other third party may not be refundable where the law permits this.

Before publication, Epicrange should adopt a specific customer-facing Refund Policy defining treatment of prepaid hosting, domain fees, installation charges, hardware, failed provisioning and duplicate payments.

Suspension and Termination

Epicrange may suspend or terminate services for material breach, unlawful or abusive use, security threats, fraud, persistent non-payment or where required by law or an upstream provider, subject to applicable notice and consumer-law requirements. Where reasonably possible, customers will be given an opportunity to remedy a breach before termination unless immediate action is necessary to protect systems, users or legal compliance.

Customer Responsibilities

  • Provide accurate registration, billing and service information and keep it updated.
  • Protect passwords, SIP credentials, API keys and other account credentials.
  • Maintain lawful rights to content uploaded, transmitted or published through the services.
  • Keep customer-managed applications and websites reasonably secure and updated.
  • Use services in accordance with law, these Terms and applicable service-specific rules.
  • Promptly notify Epicrange of suspected compromise, fraud or unauthorised account use.

Intellectual Property

Epicrange and its licensors retain rights in their brands, software, website design, documentation and proprietary technology. Customers retain rights in their own content, subject to granting Epicrange and relevant operators the limited permissions reasonably necessary to host, transmit, back up, process and display that content for delivery of the service.

Third-party software, themes, plugins and website-builder components may be governed by separate licence terms.

Privacy

Personal information is processed in accordance with the Epicrange Privacy Policy and applicable law. The Privacy Policy forms part of the legal framework governing use of Epicrange's websites and services.

Warranties and Liability

Epicrange will provide services with the level of quality and care required by applicable law. To the maximum extent lawfully permitted, Epicrange is not responsible for losses caused solely by customer equipment, customer configuration, unlawful customer content, compromised customer credentials, unsupported third-party software or events outside Epicrange's reasonable control.

Any limitation or exclusion of liability applies only to the extent permitted by South African law and must not be interpreted as excluding rights or liabilities that cannot legally be excluded. Any unusually risky or liability-limiting provision should be presented conspicuously where consumer law requires it.

Indemnity

To the extent permitted by law, a customer may be responsible for losses, claims or reasonable costs arising from the customer's unlawful use of the services, infringement of third-party rights or material breach of these Terms. This clause does not require a consumer to waive statutory rights or assume liability on terms prohibited by consumer law.

Changes to Services or Terms

Epicrange may update these Terms for legal, regulatory, security, technical or operational reasons. Material changes affecting an existing recurring service will be communicated as required by law or the applicable agreement. The current Terms will be available on the Epicrange website.

Complaints and Disputes

Customers should first submit complaints through Epicrange's designated support or complaints channel, providing the account details, affected service and nature of the complaint. Epicrange will attempt to resolve complaints reasonably and in accordance with applicable law. Nothing in these Terms prevents a consumer from approaching a regulator, ombud, court or other body where they have a legal right to do so.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any jurisdiction clause must remain subject to mandatory consumer rights and applicable rules governing where proceedings may lawfully be brought.

General

If any provision is found unenforceable, the remaining provisions continue to apply to the extent legally possible. A failure to enforce a right immediately does not necessarily waive that right. Headings are for convenience and do not alter interpretation.
